What Is Mailbox Rule?

The mailbox rule, also known as the "posting rule," is a legal principle that applies to contract law, determining when an offer and acceptance of a contract become effective.

According to the mailbox rule, an acceptance of an offer becomes effective, and thus a contract is considered formed, at the moment the acceptance is placed in the mail (or otherwise dispatched) by the offeree, rather than when the acceptance is received by the offeror.

This rule is an exception to the general principle that a contract is formed only when the acceptance is received by the person who made the offer.

The mailbox rule was developed to facilitate the formation of contracts across distances, recognizing the impracticality and unfairness of penalizing an accepting party for delays in the postal system or other delivery methods beyond their control.
